A 10-year-old boy was suspended under a school zero tolerance policy for shooting an imaginary "arrow" at a fellow classmate, using nothing more than his hands and his imagination............

The Rutherford Institute announced it has come to the defense of the boy................

"We all want to keep the schools safe, but I'd far prefer to see something credible done about actual threats, rather than this ongoing, senseless targeting of imaginary horseplay," said Rutherford Institute President John W. Whitehead.............

"Johnny Jones, a fifth grader at South Eastern Middle School, was suspended for a day and threatened with expulsion under the school's weapons policy after playfully using his hands to draw the bowstrings on a pretend 'bow' and 'shoot' an arrow at a classmate who had held his folder like an imaginary gun and 'shot' at Johnny.........

Cody Chitwood, a 17-year-old student at Lassiter High School and avid fisherman, turned himself in and was released on $1,000 bond.

“It’s pretty ridiculous,” said Chitwood in a statement to The Marietta Daily Journal. “I have an attorney and I’m hoping to get the felony dropped so I can still get in the Air Force.” If the district attorney decides to prosecute, Chitwood could face two to 10 years in prison and a $10,000 fine. A suspended seventh grade Virginia Beach student will find out soon if he is expelled for the rest of the year for shooting an airsoft gun.
Like thousands of others in Hampton Roads, Khalid Caraballo plays with airsoft guns. Caraballo and his friend Aidan were suspended because they shot two other friends who were with them while playing with the guns as they waited for the school bus.
The two seventh graders say they never went to the bus stop; they fired the airsoft guns while on Caraballo’s private property.
Aidan’s father, Tim Clark, told WAVY.com what happened next lacks commons sense. The children were suspended for possession, handling and use of a firearm.

Lydia Fox says the principal at Parkview Elementary called her earlier this month to tell Fox her 7-year-old son had misbehaved during a school assembly by pretending he was shooting a gun.

Fox says the principal told her the boy would be placed in in-school suspension for the rest of that day and threatened a longer suspension if it happened again.

Midwest City-Del City Schools spokeswoman Stacey Boyer confirmed the incident and says the district's policy is to "address the disruption of the learning environment."

Ashley Smithwick said she had never gotten in trouble before and was surprised when the principal opened her lunchbox and found the knife.

The teen was initially given a 10-day suspension, then received notice that she was suspended the rest of the school year.

“I don’t understand why they would even begin to point the finger at me and use me as an example,” she said.

This month, Ashley Smithwick, a soccer player who takes college-level courses, was charged with misdemeanor possession of a weapon on school grounds. She is no longer allowed to set foot on campus.

Christan Morales says her son just wanted to honor American troops when he made a hat decorated with an American flag and small plastic Army figures. (They are little plastic toys Mr.Principal. Are you that dense???)

But the hat ran afoul of the district's no-weapons policy because the toy soldiers were carrying tiny weapons.

"His teacher called and said it wasn't appropriate because it had guns," Morales said.................

Superintendent Kenneth R. Di Pietro said the principal told the family that the hat would be fine if David replaced the Army men holding weapons with ones that didn't have any.

"The issue for us was, can it be done in a way that didn't violate the zero-tolerance for weapons?" he said. "Nothing was being done to limit patriotism, creativity, other than find an alternative to a weapon."

Will they outlaw the Bill of Rights?
It mentions guns and soldiers in the 2nd and 3rd Amendments.

Suspended for "Rosary Beads"

Another example of "Zero tolerance" outweighing common sense.

A 13-year-old New York student was suspended for wearing rosary beads to school.

Raymond Hosier was sent home for two days over the religious symbol, visible outside his clothing.

His school district in Schenectady said students are not allowed to wear beads out of concern they may be gang-related. Hosier, however, said they're comforting since the loss of his brother and uncle.

"I was just mad that they were suspending me for rosary beads and I told them I wasn't in a gang and they must resemble my brother and uncle," he said.

Hosier said he refuses to take them off, and he could be suspended again if he wears them to school on Monday. See more here

A third-grader at Brazos Elementary was given a week’s detention for possessing a Jolly Rancher.
Leighann Adair, 10, was eating lunch Monday when a teacher confiscated the candy. Her parents said she was in tears when she arrived home later that afternoon and handed them the detention notice.
“The Texas Public School Nutrition Policy (TPSNP) explicitly states that it does not restrict what foods or beverages parents may provide for their own children's consumption.”

Brazos Elementary Principal Jeanne Young, said the problem, in this instance, was that the candy was provided by another student – not the girl’s parents.

SUSPENDED for pointing a finger??

A Michigan boy reportedly has been suspended from school for curling his hand into the shape of a gun and pointing it at another student.

Erin Jammer, said her son, Mason, was just playing around when he made the gesture Wednesday, the Grand Rapids Press reported.

"I do think it's harsh for a six-year-old. He's six and he just likes to play. Maybe what you could do is take his recess away. He's only six and he doesn't understand any of this," Erin Jammer said.

Eight year-old Christopher Kissinger from Jonesboro, Arkansas was suspended from school last week for pointing a chicken finger from the school's cafeteria at a teacher and saying "Pow, pow, pow." The boy received a three day suspension.

The Jonesboro School District has a zero tolerance policy against weapons, and the chicken finger apparently violated that policy in this incident.

There have been some shouts for common sense.
State Representative Teresa L. Schooley, Democrat of Newark, wrote, “I am asking each of you to consider the situation, get all the facts, find out about Zach and his family and then act with common sense for the well-being of this child.”

Last year state lawmakers tried to make disciplinary rules more flexible by giving local boards authority to, “on a case-by-case basis, modify the terms of the expulsion.”

The law was introduced after a third-grade girl was expelled for a year because her grandmother had sent a birthday cake to school, along with a knife to cut it. The teacher called the principal — but not before using the knife to cut and serve the cake. ( Could it be that she is a hypocrite as well as having no common sense?)

Each day before the school bus comes to pick up the neighborhood's children, Lisa Snyder did a favor for three of her fellow moms, welcoming their children into her home for about an hour before they left for school.

Regulators who oversee child care, however, don't see it as charity. Days after the start of the new school year, Snyder received a letter from the Michigan Department of Human Services warning her that if she continued, she'd be violating a law aimed at the operators of unlicensed day care centers.

Gov. Jennifer Granholm spokeswoman Liz Boyd said the agency was following standard procedure in its response. "But we feel this (law) really gets in the way of common sense," Boyd said.

"We want to protect kids, but the law needs to be reasonable," she said. "When the governor learned of this, she acted quickly and called the director personally to ask him to intervene."

When Sally Harpold bought cold medicine for her family back in March, she never dreamed that four months later she would end up in handcuffs.
Harpold is a grandmother who bought one box of Zyrtec-D cold medicine for her husband. Less than seven days later, she bought a box of Mucinex-D cold medicine for her adult daughter , thereby purchasing 3.6 grams total of pseudoephedrine in a week’s time.

Those two purchases put her in violation of Indiana law 35-48-4-14.7, which restricts the sale of ephedrine and pseudoephedrine, or PSE, products to no more than 3.0 grams within any seven-day period.
While the law was written with the intent of stopping people from purchasing large quantities of drugs to make methamphetamine, the law does not say the purchase must be made with the intent to make meth.

“The law does not make this distinction,” Vermillion County Prosecutor Nina Alexander said. (But a reasonable person would make a distiction, prosecutor.Zero tolerance laws are so stupid. Common sense should be factored in.)

So Granny could go to jail because she cares for her family?
